What is Temporary Protected Status?

Temporary Protected Status (TPS) is a program that grants migrants from unsafe countries the right to live and work in the United States for a temporary, yet renewable, period. It is designed to provide temporary refuge for migrants from countries experiencing ongoing armed conflict, environmental disasters, or other extraordinary and temporary conditions. TPS allows these individuals to live and work in the United States for a designated period, which can be extended if the conditions in their home countries remain unsafe. This program offers a vital lifeline for many who would otherwise face significant danger if forced to return to their native lands. Although TPS recipients are not recognized as lawful permanent residents or U.S. citizens, many have resided in the U.S. as it allows you to apply for adjustment of status. 

TPS holders can now pursue Legal Permanent Residency (a Green Card) in the United States via adjustment of status (AOS), as they are eligible for a TPS travel permit (Form I-512T). This permit allows them to re-enter the U.S. legally after traveling abroad and gives them a new status, from which they can obtain AOS. While TPS alone does not grant eligibility for residency, TPS holders who have legally entered the U.S. can obtain residency through sponsorship by a spouse, a family member (such as a parent, an adult child, or a sibling), or an employer.
