If you’re a citizen of Canada or Mexico and have a job offer in the United States, the TN visa can provide a relatively fast and straightforward path to working legally in the U.S. Created under the North American Free Trade Agreement (NAFTA) and continued through the United States-Mexico-Canada Agreement (USMCA), this visa is designed for certain professionals coming to work in pre-approved occupations.

At Rahimi Law Firm, P.C. we help workers and employers through the TN visa process—from assessing eligibility to preparing documentation. Whether you’re coming to New York or another part of the country, we’re here to make the process smooth and less stressful.

Who Qualifies for a TN Visa?

To be eligible for a TN visa, you must meet specific requirements under the USMCA agreement. This visa is limited to citizens of Canada and Mexico who are taking up professional roles that appear on the approved list.

Here’s what’s required:

  • You must be a citizen (not just a resident) of Canada or Mexico.
  • Your job offer must fall under a listed profession, such as:
    • Accountant
    • Architect
    • Engineer
    • Computer Systems Analyst
    • Scientific Technician
    • Registered Nurse
    • College or University Teacher
  • The U.S. employer must provide a written job offer.
  • You must have the education, license, or credentials required for the role.

We can review your background and your offer letter to see whether your job and qualifications line up with USMCA requirements.

Application Process for TN Status

Applying for a TN visa depends on whether you’re from Canada or Mexico. While both groups must meet the same criteria, the process looks a bit different:

For Canadians:

  • You don’t need to apply at a consulate.
  • You can request TN status directly at a U.S. port of entry, such as an airport or land border.
  • Bring your passport, a letter from your employer, and documentation proving your qualifications.

For Mexicans:

  • You must apply for a TN visa at a U.S. embassy or consulate in Mexico.
  • Once approved, you can then enter the U.S. with TN status.

Regardless of your country, we’ll make sure your application package is complete, accurate, and aligned with your intended role in the U.S.

How Long Can You Stay on a TN Visa?

TN visas are granted in three-year increments, but you can apply for extensions as long as the qualifying employment continues. There’s no official limit to how many times the visa can be renewed.

Keep in mind, though, that TN visas are considered nonimmigrant visas, meaning they’re intended for temporary stays. If you plan to pursue a green card in the future, we can help you evaluate your options and understand how a TN visa may fit into that long-term plan.

Common Issues We Help Resolve

Even though the TN process can be faster than other employment visas, it’s not without its complications. We regularly help individuals and employers with:

  • Denials at the border due to missing or unclear paperwork
  • Confusion over job duties that don’t match the USMCA list
  • Issues with extensions or renewals, especially after a job change
  • TD visa questions for spouses and children who want to join the TN visa holder in the U.S.

If any part of the process raises questions or concerns, we’re here to talk you through it and find a solution.
